• The given offer will vary according to Mobily’s assessment of the financial ability of the customer and the device that the customer selects according to the Mobily’s policy. Minimum commitment period is (24) consecutive billing cycles Which represents the period of validity of the contract with full payment of committed monthly fees.
  • The minimum commitment in the device installment contract is (24) full billing cycle, which represents the validity period of the contract with the full payment of the monthly bill.
  • In case customer request to cancel the contract then he shall pay the amount needed penalty for remaining unpaid period (pro-rated on a monthly basis).
  • Remaining commitment value = (device monthly instalment fee* remaining unpaid commitment value) And VAT of the penalty also
  • In case customer fail to pay the due commitment amount for devices Offer, then Mobily has the right to: o Demand payment from the customer o Initiate appropriate legal action for the recovery of the amounts due. o Add the name of the defaulter in the lists of the Saudi Credit Bureau (SIMAH). o Prevent customer from getting the instalment again
  • Mobily has the right to evaluate the eligibility of the customer and based on SIMAH evaluation, in new subscription or after finishing the current commitment, and it has the right to decline the customers’ request in getting the device instalment program
  • By signing this contract, the customer acknowledges and agrees that Mobily will increase the customer’s credit limit at Mobily upon obtaining the devices installment program by the equivalent of the monthly installment fee in addition to the VAT
  • The device’s warranty shall be as per the warranty terms identified by the original manufacturer, without any liability to Mobily for any fault or manufacturing defect(s). The warranty will not cover the damage caused by incorrect installation, use, modification, or repair by any unauthorized 3rd party or by the customer himself/herself. The warranty will also not cover any damage caused by external events (such as accident, problems with electric power, defects caused by use of parts and components that are not supplied by Mobily or its Partner.
  • The customer shall comply with the software license terms and conditions of the equipment manufacturer for the device.
  • In case of any defect or technical issues or the need for repair or maintenance or any other matters related to the devices sold in accordance to this contract, it is referred to the agent of the device according to the guarantee attached to the device and through the client directly.
  • Refund and replacement based on Mobily’s Policy
  • Mobily has the right to determine the maximum number of devices that can be taken and the customer can obtain only one device with the same ID No.
  • The prices not including VAT, VAT will be calculated in each billing cycle
  • Customer acknowledges that the device already purchased under this contract is subjected to the marketing offer of Mobily
  • Mobily may immediately terminate this Devices Terms & Conditions contract at any time by giving the Customer a prior written notice if the Customer has breached any of its obligations hereunder this Devices Terms & Conditions, Mobily shall not be liable or responsible to Customer for any violation or breach resulting out or in connection with such termination. Moreover, the Mobily will not be undertakes to pay any losses, expenses or compensations claims raised by the Customer regarding this termination.
  • This contract is subject to the laws and regulations of the Kingdom of Saudi Arabia and the terms and conditions of this Contract. The Saudi Court has the right for any interpretation over this Contract
  • In the event of a conflict between the Arabic text and the English text, the applicable and approved text is the Arabic text.
  • The customer acknowledges with full legal and legal capacity, that he is aware of acquainted with and (accepts) all the clauses contained in this contract.
  • This contract was issued in (two copies) for each party to work according to it
